Individual Use Terms

​1. Grant of License

Upon full payment, naturefoc.us (“Grantor”) grants the Purchaser a non-exclusive, non-transferable, and perpetual individual license to use the digital image(s) for Personal Use only.

​2. Retained Rights (Copyright)

The Grantor maintains all copyright, title, and ownership of the image(s). This purchase does not transfer ownership of the copyright.

​3. Attribution Requirement

When displaying the image(s) on public social media platforms or personal websites, the Purchaser agrees to provide clear credit to the Grantor.

  • ​Required Credit: "Photo by naturefoc.us”

​4. Permitted Uses

  • ​Display on personal social media profiles (with attribution).

  • ​Printing copies for personal display (home or office).

  • ​Use as personal device wallpapers.

​5. Prohibited Uses

The Purchaser may not:

  • ​Resell, sublicense, or redistribute the digital files.

  • ​Use the images for any commercial purpose, including advertising, promotion, or company branding.

  • ​Enter the images into AI training sets or "Generative AI" databases.

​6. Commercial Inquiries

This license does not cover business or commercial use. If you are interested in using these images for commercial purposes (e.g., marketing materials, book covers, website headers for a business, or resale), please contact naturefoc.us to negotiate a separate Commercial License Agreement.

​7. Refunds and Delivery

Due to the nature of digital products, all sales are final. No refunds will be issued once the digital file has been delivered or downloaded.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Wahington State, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement will be brought exclusively in the courts located in King County, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

9. Limitation of Liability

In no event shall the Grantor (naturefoc.us) be liable for any indirect, incidental, or consequential damages arising out of the use of the digital images. The Grantor’s total liability for any claim arising out of this Agreement shall not exceed the amount paid by the Purchaser for the image(s) in question.

10. Indemnification

The Purchaser agrees to indemnify and hold harmless the Grantor from any and all claims, liabilities, and expenses (including legal fees) arising from the Purchaser’s use of the image(s) in any way that violates the terms of this Agreement.

Commercial Use Terms

1. Grant of License

Upon receipt of full payment, naturefoc.us (“Grantor”) grants the Purchaser a non-exclusive, non-transferable, and perpetual worldwide license to use the digital image(s) for the commercial purposes defined in Section 3. This license is granted to the individual or entity named on the invoice and may not be assigned or sub-licensed to third parties.

2. Retained Rights (Copyright)

This agreement is a license to use the image(s), not a transfer of ownership. naturefoc.us maintains all copyright, title, and intellectual property rights in and to the image(s). All rights not expressly granted herein are reserved by the Grantor.

3. Authorized Commercial Uses

The Purchaser is permitted to use the image(s) for:

  • Marketing & Advertising: Digital advertisements, social media campaigns, and email marketing.

  • Corporate Use: Internal presentations, annual reports, and company websites.

  • Promotional Materials: Brochures, business cards, and physical signage.

  • Editorial: Use in blog posts, articles, or digital publications.

4. Prohibited Uses

The Purchaser may not:

  • Resale of Assets: Sell, sublicense, or redistribute the image(s) as standalone files, prints, or as part of a stock photo library.

  • Merchandise for Sale: Use the image(s) on products for resale (e.g., apparel, mugs, posters) where the image is the primary value of the product. This requires a separate Retail/Merchandise Addendum.

  • Trademark: Incorporate the image(s) into a logo or registered trademark.

  • AI Training: Use the image(s) in any machine learning or generative AI training datasets or "text-to-image" models.

5. Prohibited Sensitive & Illegal Uses

The Purchaser shall not use the image(s) in any manner that is:

  • Defamatory & Degrading: Libelous, obscene, immoral, or intended to harass or degrade any person, group, or entity.

  • Illegal: In connection with any illegal activity or in violation of any applicable laws or regulations.

  • Sensitive Topics: In a context that implies an endorsement by naturefoc.us of any political party, religious group, or controversial social issue without express written consent.

  • False Representation: Falsely representing, expressly or by way of reasonable implication, that the image(s) were created by the Purchaser or any person other than naturefoc.us.

6. Term and Territory

This license is perpetual and worldwide, granting the Purchaser the right to use the image(s) indefinitely across all geographic regions, subject to the restrictions in Section 4 and 5.

7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Washington State. Any legal action or proceeding arising under this Agreement will be brought exclusively in the courts located in King County, and the parties hereby consent to the personal jurisdiction therein.

8. Limitation of Liability

In no event shall naturefoc.us be liable for any indirect, incidental, or consequential damages. The Grantor’s total liability for any claim arising out of this Agreement shall not exceed the original amount paid by the Purchaser for the license.

9. Indemnification

The Purchaser agrees to indemnify and hold harmless naturefoc.us from any and all claims, liabilities, and expenses (including legal fees) arising from the Purchaser’s use of the image(s) in any way that violates the terms of this Agreement.

10. Quantity & Usage Limits

This "Standard Commercial License" is limited to a total of 200,000 physical copies or "impressions" (e.g., total prints of a brochure or total reach of a boosted social post). Usage exceeding this limit requires an Extended Commercial License. Contact naturefoc.us for high-volume pricing.
